There are two main types of bankruptcy. Chapter 7 is used for most people who cannot afford to pay their debts because they have lost a job or lost other sources of income. Chapter 13 is used typically used by homeowners who want to save their homes from foreclosure but the bank has failed to modify their loan.

Chapter 13 is also required of people who are employed and make too much money to have their debts completely wiped out by the bankruptcy laws. These people who file Chapter 13 end up with a repayment plan, whereby the client makes a monthly payment to cover a certain portion of their debts.
